Vader's "I have you now" bug

It may just be me, but since I've had Vader and his ship (which I've had for longer than I can remember), every time I've tried using "I have you now" I have had it resisted 100% of the time. I don't really know why I bothered upgrading that move to be honest...

Does anyone else have this problem? Possibly a bug?

Personally don't have this problem. It works for me more often than not. Although I only use the move on TL'ed foes, takes away tm that way AND his unique decreases enemy ship tenacity a bunch. Ships seem to naturally have high tenacity and low potency
