Tie Silencer, is basic advantage mechanic WAI?

I use Silencer in my fleet, and the basic says "if the target has less than 50% turn meter, Tie Silencer gains advantage after attacking."

However, whenever tie silencer already has advantage and attacks a character with less than 50% turn meter, the advantage does not refresh. WAI?

When posting if you can provide more information, i.e. does TS get advantage if target evades? Or any other situation where he does or does not gain advantage. This will help highlight in the sequence where the issue is.
