FOSFTP Assist Special WAI or bugged?

In t7 p2, when FOSFTP calls my FOE for an assist, Sion counterattacks, even when FOSFTP has no stacks of pain. FOE typically has cycle of suffering.

So, is that a bug, or is it WAI? I'm thinking it's the former. Has anyone else run into this?

Looks like a bug. Sion should only get +10% counter chance per cycle of of pain on the Attacker, (+60% for Cycle of suffering). If FOSFTP has no stacks, Sion really shouldn't be countering.
