Rogue Action for "opponent already engaged in battle"

Many guilds use the rogue action count to track individual win rates in TW. Problem is, when someone attacks a team that is already engaged (which shouldn't happen in the first place), their RA counter goes up.

This doesn't happen when one clicks "disobey order" and backs out again without starting the battle, which leads me to believe this behavior isn't WAI. Clearly it isn't the click on the disobey button that's supposed to count as a RA but actually entering the battle.

Can this be fixed at some point? It always feels like a lame excuse to tell your guild officers you've run into this problem, especially if they've never heard of this or experienced it themselves. Alternatively, it would be great if guild officers could get some proper metrics without having to block territories.
