Deathmark not working in TW?

Not sure if this is WAI but if you enter a battle against an opponent that has a dead team member in TW i would assume that deathmark (Deathtroopers ability) should work immediately as a member of the enemy team is dead but it does not. This seems a little unfair but i can understand if this is WAI would just like some confirmation as it seems like it could be a bug.

The debuff is encounter based. It will only trigger if you defeat an opponent after you start your attack

Death mark only effects a toon that dies with the debuff active on them upon death.

So not a bug.

Umm, this doesn't sound like the right explanation at all.

But I think it's just that it's encounter based so you have to kill someone in your encounter before terminate will apply deathmark
