    Nothing to fix. The ability from the modifier is a destroy effect.

    Annihilate effects aren't damage.
    This is working as intended.
    If I face you with Nihilus, I can do the same thing.

    Show me one frame where he's actually below 100% health but not dead.

    The ability (the one at 5% charge there) is an insta-kill. It's usable by both sides.
    Insta-kill =/= dropping below 100% health. It's simply "is defeated".

    I don't see anything wrong here.
